Benidorm advances in the first step to unlock the works of the cultural center

The plenary vote on Monday to initiate the file to annul the right of surface that was granted to the SPTCV on the ground and to change it by a grant of demanial concession

An opinion from the Juridical Council will also be requested

Benidorm City Council will advance in the protocol agreed with the Generalitat Valenciana to resume the works of the cultural center. To this end, the full body of the corporation will vote next Monday, August 28, to start the file to change the legal figure by which the soil where the building is, it was made available to the Society of Thematic Projects of the Valencian Community (SPTCV).

Thus, the Mayor's proposal will be to declare the nullity of the surface right that was granted to the SPTCV and its replacement by a demanial concession, a legal figure that is exempt from VAT.

The Councilor for Finance and Urban Planning, Lourdes Caselles, recalled that this change "is the first of the steps set by the technicians of the Generalitat and the City Council to unblock the situation in which the cultural center is located." Caselles has deepened that "it is not minor change, since the right of surface has generated to the City council a disbursement of about 1.5 million euros by means of VAT of the ground". An annual VAT, has specified, that "would be annulled if the surface right was replaced by a concession".

In addition to operating this change, the proposal will also include asking the Consell Jurídic Consultiu (CJC) to give approval to the terms agreed by the City and the Generalitat to resume construction of the building, which should be reflected in a new agreement that will replace the Signed 11 years ago now.

Caselles recalled that apart from establishing the demanial concession, the agreement includes that the investment announced by the Valencian government is contemplated as a first phase of work in which the room is smaller than 546 seats, the professional conservatory of music and dance , and the cafeteria, and in which also the treatment of the façades and the covers of all these zones is realized.
